PRIVACY POLICY

Back Off Scotland Privacy Policy

 

This privacy notice relates to all personal information collected, used and stored by the Back Off Scotland group in the pursuance of its campaigns for local and national buffer zones outside facilities providing abortion services. 

1. Personal contact information

Back Off Scotland collects identification information and contact details for the purpose of communicating with its supporters. Personal information is collected, used and stored for this purpose on the basis of consent. 

In accordance with the General Data Protection Regulations (EU) 2016/679 (GDPR), Back Off Scotland will hold and process your personal data in order to provide the services or information you have requested. This data will not be sold or passed on to any unrelated party. We will not collect or store unnecessary personal information. 

2. Subject access requests

You have the right to see what personal contact information Back Off Scotland holds about you and how it is used. Subject access requests should be sent to contact@backoffscotland.com.  All requests will be dealt with as soon as possible and within the legal requirement of one month. 

3. Updating your personal contact information

You have the right to ask us to update the personal contact information Back Off Scotland holds on you. Update requests should be sent to contact@backoffscotland.com.

4. Deletion of personal contact information

Unless otherwise directed, Back Off Scotland will store the personal contact information necessary to communicate with our supporter base until such time as our defined mission has been achieved. This will be when Gillian Mackay MSP's Safe Access (Abortion Services) Scotland Bill has withstood all legal challenges and is expected to remain in place for at least a further two years OR when national legislation has been passed which achieves the same level of protection for clinic users. At this point all personal information will be deleted. 

If you no longer wish to receive updates from Back Off Scotland you have the right to ask for your contact information to be removed from our database. Either email us on contact@backoffscotland.com or click the ‘unsubscribe’ link at the bottom of one of our emails.

 

5. Collection of personal contact information

You can access most of the pages on our website without giving us your personal contact information. However, you may choose to provide us with your personal information on some pages of the website, for instance by completing a Sign Up form or a Contact Us form. You can also sign up to receive Back Off Scotland updates by email.  

Every effort has been made to ensure that information sent over the internet is secure and that your details will remain confidential and accessible to only those who need to know that information in order to provide the service/information requested. 

6. Usage of personal contact information

We will use your information as follows: 

  • When you contact us about a personal experience with anti-choice protestors - we will use the information you have given us as part of our ongoing evidence base when engaging with the police, the Scottish Government, the Scottish Parliament, BPAS, or any other body actively involved in making decisions regarding local or national legislation for safe zones outside abortion clinics. We will anonymise this information and will not pass your name or any other identifying information to any of these bodies without your explicit permission. 

  • When you fill in a Sign Up form - we will we add you to our secure email database to receive campaign updates. You can unsubscribe from these at any time. 

  • When you fill in a Contact Us form - we will respond to your specific query/request as soon as we can. We will use the email address you have provided to contact you unless you have included a telephone number, or other form of contact, within the message field of the form and have explicitly asked us to use that as your preferred method of contact. We will also add you to our secure email database to receive campaign updates. You can unsubscribe from these at any time. 

 

Your personal contact information will only be used by representatives of Back Off Scotland and BPAS to provide the services/information described above and will only be accessible to those who need to see it in order to carry out those services. Members of Back Off Scotland will not use your personal information to contact you for other purposes unless a personal relationship already exists between you and that Back Off Scotland member. 

7. Storage of personal contact information

Your personal contact information is held securely online, in a password-protected contact file within a restricted access area. It will only be accessed for the purpose of communicating with you, updating or deletion. 

When you send us personal contact information - name, email, address etc - via our website forms  this data is securely transferred by our website host to the restricted-access Back Off Scotland email account. If you have provided personal contact information because you want to report harassment, volunteer, or to receive updates from us, your data will be added to the relevant, secure file, until such time as we no longer need it or you ask us to delete it. 

Your data is not retained by our website host. 

If you contact us via our social media accounts we will respond to you via the same medium, unless requested otherwise. If you provide us with other personal contact information via our social media accounts your data will be added to the relevant, secure file, until such time as we no longer need it or you ask us to delete it. 

8. Third party storage and processing of personal contact information

We only share your personal contact information with GDPR-compliant third parties for the purpose of storing, processing and delivering our communications to supporters. These third parties (such as MailChimp, Dropbox, Eventbrite and SurveyMonkey) are not allowed to use your information for any other purpose.

 

GDPR requires that personal data shall not be transferred to a country or territory outside the EEA unless that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data. We will only use third party suppliers who comply with this GDPR requirement. 

Back Off Scotland uses MailChimp to send updates by email to our database of supporters. MailChimp is a US-based company. MailChimp participates in, and has certified its compliance with, the EU-US Privacy Shield framework. 

Personal information provided on website forms - eg Sign Up, Contact Us - is processed by our website host, Wix. Wix does not retain your personal data once it has been passed to Back Off Scotland. 

9. Automated collection of personal information

Back Off Scotland is committed to protecting the privacy of all individuals using this website. Our website is hosted by Wix. The GDPR regulates how individuals and organisations may collect, use, and retain personal data, which affects both Wix and sites (including ours) which run on Wix's platform. 

 

As with many other websites, when you access pages on the Back Off Scotland website certain information provided by you is automatically recorded. When you visit our website, the Wix server will record your computer's IP address (the unique numerical address given to every computer connected to the internet) and the time and duration of your visit and your interactions with our site. This is used in an anonymous, aggregated or pseudonymised form which does not focus on you individually. This data is used to evaluate, provide, protect or improve Wix services. 

Back Off Scotland does not use IP addresses to identify or profile individuals. 

10. Cookies

A cookie is a small data file made up of letters and numbers which is placed by a website on the device you use to access the internet. Cookies are then sent back to the originating website on each subsequent visit, or to another website that recognises cookies. At a basic level, cookies are used by the website host to provide data about how the website is being accessed or to improve the performance and security of the site. Continued use of the Back Off Scotland website means that implied consent has been given to Wix to place performance and security cookies on your device, unless you have blocked these using your browser settings. 

Analytics cookies can be used to tailor the experience of users and to target content. Back Off Scotland has elected to disable analytics cookies on this website. Should this change we will ensure that visitors to our site are informed and we will update this policy to reflect such changes. 

11. Photographic and video images

As part of its core purpose of campaigning for buffer zones outside abortion clinics, Back Off Scotland collects and holds photographic and video evidence taken outside clinics or at events.

 

This information is collected, stored and processed on the basis of the legitimate interest of our organisation and may be shared with relevant third parties - such as the police, the Scottish Government, the Scottish Parliament, and BPAS - for the purpose of evidencing harassment and intimidation of clinic users both locally and nationally.  

We do not assign any personal identification or contact information to people appearing in our photographic or video evidence images. Nor do we hold or use images of clinic users. 

12. Changes to this privacy policy

Any significant changes to this privacy policy will be advertised via our email updates and/or social media platforms.
